In May 2024, FKB filed a class action alleging that Apple exploited its monopoly position in the smartphone market through anticompetitive techniques that stifle innovation by third parties. The case seeks damages on behalf of the millions of consumers who have overpaid for iPhones because of Apple’s monopolistic conduct.  


This case and others by private plaintiffs who bought iPhones were consolidated in the District of New Jersey, where the U.S. Department of Justice and sixteen states also filed a civil complaint accusing Apple of violating the antitrust laws.
