Fusion Elite All Stars v. Varsity Brands, LLC

STATUS — Closed

PRACTICE — Antitrust

CASE — No. 20-cv-02600, U.S. District Court for the Western District of Tennessee

FKB and other firms sued the dominant producer of All Star Cheer competitions, as well as the sport’s main governing body, in this case alleging monopolization of the market for All Star competitive cheerleading.

The plaintiffs—gyms and spectators—alleged that the defendants’ actions illegally inflated the cost to participate in and attend All Star Cheer events.

In 2023, the parties agreed to a settlement that included $43.5 million in cash and significant prospective relief. In October 2023, the court certified the settlement classes and granted final approval.
