CASE — MDL No. 5944, U.S. District Court for the Northern District of California

FKB served on the indirect purchaser plaintiffs’ trial team in this case alleging price-fixing in the cathode ray tube industry. Class members reached a settlement of more than $547 million with nearly all defendants—one of the largest recoveries ever achieved on behalf of indirect purchasers. The U.S. Court of Appeals for the Ninth Circuit affirmed the district court’s final approval of the settlements.

In 2024, the district court imposed terminating sanctions against the non-settling defendants for noncompliance with discovery obligations and violating court orders. The court held a three-day evidentiary hearing on damages in May 2025. FKB was involved in all aspects of preparation and strategy, including witness preparation, work relating to exhibits and demonstratives, evidentiary issues, and related briefing.
