In 2022, the Honorable Joy Flowers Conti appointed FKB’s Roberta Liebenberg as the Chair of the Plaintiffs’ Settlement Committee in this RICO and consumer protection case involving defective foam in millions of recalled sleep-apnea machines and ventilators. Ms. Liebenberg and FKB also played a critical role in motion-to-dismiss briefing and discovery.
The case settled in 2024 for over $1.5 billion—$1.075 billion for personal injury claims, $506 million for economic loss claims, and $25 million for medical monitoring claims.
