FKB’s Roberta Liebenberg serves on the expert committee for this nationwide class action alleging that outpatient medical centers conspired to restrain competition by agreeing not to hire each other’s employees. FKB also played an active role in briefing and non-party discovery.


The case alleges that the conspiracy disrupted the efficient allocation of labor that would have resulted if the defendants had competed—rather than colluded—for employees. The plaintiffs also allege that the defendants’ conduct suppressed workers’ mobility and compensation. 


The plaintiffs achieved a favorable motion-to-dismiss ruling, and the case is currently in discovery.
