FKB defended Southwest Airlines in a nationwide class action case alleging that major airlines violated the antitrust laws by colluding to decrease capacity and raise prices.   


The plaintiffs in the case alleged that United, American, Delta, and Southwest agreed to restrict capacity on domestic air travel. The firm negotiated a class settlement between Southwest and the plaintiff class. American Airlines subsequently settled—also on a class-wide basis—for three times the amount Southwest paid. 


The district court granted final approval and, in 2021, the settlements withstood an appeal to the U.S. Court of Appeals for the District of Columbia Circuit.
